Draconian
古代アテネの立法者ドラコンの名から。
接尾辞 -ian は、所有格、乃至、
そのもの (者・物)の性質ややり方を
示す形容詞を形成する。
ドラコンは人名だが、字面は「龍、おろち、怪物」
名は体を表すというが、ドラコンには
その格言が当てはまる。
ギリシャ神話のドラコンは
縄張りやお宝を守るため、
挑みかかってくる英雄どもと
その手先どもに
「情け容赦なかった。」
Draconian は、字面通りなら、
ドラコン的な、
ドラコン風の、
ドラコンの、
といったことを表す。
ドラコンは紀元前六二一年にアテネ法を制定。
その法はたいへん厳格で、
なまけるといった、今では
犯罪でもなんでもないことにまで、
死刑を適用していたし、
法の運用も厳格であった。
但し、法廷の判決のみ有効で、
その点では、現代の司法制度の
基礎を作ったといえるだろう。
紀元前四世紀の扇動政治家デマデスは、
「ドラコン法はインクではなく、
血で書かれていた」と伝えている。
ドラコン以前には、
目には目を、歯には歯を
の、被害者に仇討ちを認める
復讐法があった。
アテネにソロンと呼ばれる
新たな政治家が出現して、
ドラコン法は改正された。
